Proposed Deed Restriction 9. Maintenance Fund: (b) Said annual charge may be adjusted from year to year, after 1963 by the Grantor or the Kirkwood Improvement Association, as the needs of the property may in their judgement required, but in no event shall such a charge be raised above $20.00 per lot, except by the approval and consent in writing of the owners of 75% of the lots in said plat which approval and consent shall make any such additional assessment binding upon all of the owners of the property in said plat (Amended 6/24/2019 from $75.00 to $150.00)(Amended X/XX/2025 Annual inflationary adjustments may be authorized by the elected officers of the Association and will not exceed the annual 12 month rolling Consumers Price Index released by the Bureau of Labor Statistics for the month of September of the preceding calendar year.) Proposed By-Law update Charges and Assessments: Section I - The annual maintenance charge of one hundred fifty dollars ($150.00) (Approved 09/2018) is payable from each property in the Kirkwood No. 1 & No. 2 subdivisions in January of each calendar year. An annual inflationary adjustment to the maintenance charge, if approved by the elected officers of the Association, will not exceed the annual 12 month rolling Consumers Price Index released by the Bureau of Labor Statistics for the month of September of the preceding calendar year, rounded to the nearest dollar.
